These two Criminal Petitions are filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners who are arrayed as Accused Nos.1 and 2 in Crime No.277 of 2022 on the file of Station House Officer, Chaderghat Police Station, Hyderabad registered for the offence punishable under Section 8(c), 20(b)(ii)(c) and Section 29 of Narcotic Drugs and Psychotropic Substances Act, 1985. 2.

Since the petitioners are Accused Nos.1 and 2 in the same Crime i.e. Crime No.277 of 2022, both the criminal petitions are heard together and disposed off by this common order. 3.

Heard learned counsel for the petitioners and learned Public Prosecutor for the respondent-State. Perused the record. 4.

The facts of the case are that the petitioners were apprehended with 66 kgs of ganja by the Chaderghat Police while being transported in a vehicle. The police seized the said

contraband and after following due procedure under NDPS Act sent the samples drawn to the FSL for the purpose of report, then the petitioners were remanded to judicial custody. 5.

On instructions learned Assistant Public Prosecutor submits that the investigation is not yet complete and Accused No.3 is yet to be apprehended.

Keeping in view that the quantity seized is commercial quantity, this Court is not inclined to grant the relief of bail to the petitioners/Accused Nos.1 and 2 at this stage. 7.

Accordingly, both the Criminal Petitions are dismissed. However, the petitioners are at liberty to renew their bail application before this Court under changed circumstances. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 19.10.2022 ns
