THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.28055 of 2009 ORDER:

Heard learned counsel for the parties.

2. Petitioner complains against the action of the fourth respondents in not permitting the husband of the petitioner to proceed on Invalidation Pension on medical grounds as illegal, arbitrary and unconstitutional.

3. On 23.12.2009, this Court passed the following interim order: "Notice.

There shall be a direction to the respondents 2 and 4 to consider the representation of the petitioner dt.26.09.2009 and pass appropriate orders in accordance with law within a period of four weeks from the date of receipt of this order."

4. Having regard to the interim order granted on 23.12.2009, no further order is necessary. However, if the representation pursuant to the order dated 23.12.2009 was considered and disposed of and the petitioner is aggrieved thereby, it is needless to observe that the petitioner can work out the remedies in accordance with law.

The writ petition is disposed of accordingly. As a sequel, the miscellaneous applications, if any pending, shall stand closed. There shall be no order as to costs.
