THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.33246 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus to direct the third respondent to dispose of the representation of the petitioner dated 16.3.2016. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Land Acquisition. It is the case of the petitioner that the Government acquired his land including the well. It is the further case of the petitioner that the Government has not paid compensation to him in respect of the said well.

The record reveals that the petitioner submitted a representation to the third respondent on 16.3.2016 with a request to pay compensation in respect of the well acquired by the Government. But for one reason or the other, the third respondent has not disposed of the representation of the petitioner. The only relief sought by the learned counsel for the petitioner is to direct the third respondent to dispose of the representation submitted by the petitioner on 16.03.2016 as expeditiously as possible.

In view of the submission made by the learned counsel for the petitioner, this Court is not expressing any opinion touching the merits of the main case.

Having regard to the submission made by the learned counsel for the petitioner, the third respondent is hereby directed to dispose of the representation submitted by the petitioner on 16.03.2016 in the light of the Letter No.EE/Divn.No.4/IFFCC.1/DB/T3/149/14 dated

07.03.2014 of the Executive Engineer, as expeditiously as possible, preferably, within a period of three months from the date of receipt of a copy of this order.

Accordingly this Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
