HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.4893 of 2017 ORDER:

The petitioner seeks enforcement of Award passed by the lower Court at Guntur in I.D. No.41 of 2003, dated 02.09.2005. Since there is an effective and efficacious remedy available to the petitioner seeking enforcement of the award under Section 11 of the Industrial Disputes Act, 1947, the petitioner cannot come before this Court for implementation of the Award passed by the lower Court. When the matter is taken up for consideration, this Court is informed that the Officer concerned is now posted to the lower Court at Guntur.

Hence, the Writ Petition is disposed of leaving it open to the petitioner to avail the remedy under Section 11 of the Industrial Disputes Act, seeking enforcement of the earlier award, passed by the lower Court.

No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
