THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Contempt Case No.1397 of 2015 ORDER:

This contempt case is filed alleging wilful disobedience of the order dated 24.03.2015 passed in W.P.M.P.No.10163 of 2015 in W.P.No.7672 of 2015 by this Court. The said order reads as under: "There shall be interim direction to respondents 2 to 5 to consider the representations dated 09.06.2008, 02.02.2015, 09.02.2015 and 09.03.2015 and pass orders, in accordance with law, within eight weeks from today." A perusal of the same discloses that it is only to the effect that the representations alleged to have been made by the petitioner may be considered and orders may be passed within a time frame. In obedience to the orders of this Court, the Tahsildar, Owk Mandal, Kurnool District, considered the representations of the petitioner and passed an order by way of an endorsement dated 25.04.2015 rejecting the claim of the petitioner. A copy of the same is also placed on record.

Though learned counsel for the petitioner made an endeavour to canvass as to how the endorsement dated 25.04.2015 is unsustainable and is required to be interfered with, this Court is not inclined to entertain such a contention in the contempt jurisdiction and it is for the petitioner to challenge the correctness or otherwise of the same in separate proceedings.

Learned counsel further submits that the petitioner had already filed an amendment petition in the writ petition, which is pending, seeking permission of the Court to challenge the endorsement dated 25.04.2015.

In that view of the matter, the contempt case is closed leaving it open to the petitioner to challenge the endorsement dated 25.04.2015 in the pending writ petition. There shall be no order as to costs.
