K.V. Nageswara Rao v. The Andhra Pradesh Administrative Tribunal At Hyderabad
HON'BLE SRI JUSTICE SURESH KUMAR KAIT & HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P. No. 23610 of 2018 COMMON ORDER:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present writ petition, the petitioner is challenging the order dated 07.06.2018 in O.A.No.1074 of 2018 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, whereby the application filed by the petitioner under Section 19 of the Administrative Tribunals Act, has been dismissed.
Perusal of the impugned order shows that learned Tribunal has suggested the petitioner to avail appellate right before the competent authority, which has not been availed of by the petitioner. Since the final order has not been passed by the 1st respondent, it is needless to say that on passing of final order, the petitioner may challenge the same before appropriate Forum.
Accordingly, the writ petition is dismissed. There shall be no order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
