ORDER

This writ petition is filed for the following relief: "to issue an appropriate writ or order direction more particularly one in the nature of Writ of Mandamus declaring as illegal and arbitrary the proceeding Rc.No.116/07/SA, dated 20.03.2007 issued by the 2nd respondent and set aside the same insofar as it relates to land of an extent of Ac.3.97 cents covered by S.No.135/6A in Kurmannapalem Village, Gajuwaka Mandal, Visakhapatnam District and issue consequential directions to the 3rd respondent to receive the documents presented by the petitioners for registration and pass such other or further order or orders as are deem fit and proper in the circumstances of the case."

When the matter was taken up for consideration on 29.06.2017, it was adjourned for getting instructions by the learned Government Pleader with regard to treatment of the land as on today.

Learned Government Pleader, based on instructions, submits that the land in Sy.No.135/6A of Kurmannapalem was entered in 22-A register of Gajuwaka Mandal, published on 16.6.2016 at Sl.No.57 with remarks "the request of deletion from 22 (A) list of 2014 shall be taken up basing on the outcome of the pending Court case". He further submits that as of now, in an extent of 255 square yards, there is a two

storied building of M.Koteswaramma, in an extent of 255 square yards, there is a commercial complex of S.K.Vijaya Kumari, and in an extent of 404 square yards, there is a Hotel Ramachandra of G.Ramachandra Rao and in other extents of land, only basement is existing.

In the circumstances, the Writ Petition is closed giving liberty to the petitioner either to make proper application to the District Collector for deletion of the lands from 22-A Register or if so advised, to challenge the inclusion in a separate writ petition.

Miscellaneous petitions, if any, pending shall stand closed.
