Heard the counsel for petitioner, and the learned Government Pleader for Transport (Telangana) for respondents. 2.

The petitioner is aggrieved by the inaction of respondents in not issuing / renewing Form - 38 Certificate of Fitness to petitioner's vehicle bearing No.AP-29-TB-7175.

The counsel for petitioner states that petitioner has complied with all the requirements of the Motor Vehicles Act, 1988, and the rules framed therein. But, for reasons unknown, the respondents are not issuing the said certificate.

The counsel for petitioner further states that petitioner had made a representation on 28.07.2016 to respondent nos.2 and 3, and that no action has been taken on the said representation till date. 5.

The learned Government Pleader for Transport (Telangana), appearing for respondent nos.2 and 3, states that respondent nos.2 and 3 will issue Form - 38 Certificate of Fitness to petitioner within a period of one (01) week subject to compliance by petitioner of the procedure in regard thereto.

Accordingly, the Writ Petition is disposed of directing respondent nos. 2 and 3 to renew the Form - 38 Certificate of Fitness to the above vehicle of petitioner within a period of one (01) week from the date of receipt of a copy of this order, subject to complying with all the formalities in the Act. No order as to costs. 7.

As a sequel, miscellaneous petitions pending if any in this Writ Petition, shall stand closed.
