THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36097 OF 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in opening a rowdy sheet pursuant to the proceedings of the third respondent vide C.No.27/ACP-WZ/2014, dated 03.06.2014, as illegal and arbitrary and consequently to set aside the same. Heard and perused the material.

Learned counsel for the petitioner submits that without the knowledge of the petitioner, four cases are booked against the petitioner, which are petty in nature and that in three cases, the petitioner was acquitted of the offences and only one case is pending adjudication. He further submits that the petitioner is a respectable person and he commands respect in the society and as such, seeks a direction to the respondents to close the rowdy sheet pending against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the third respondent stating that he is not involved in any offences after 2014 and that even earlier cases also registered for the offences of petty nature and on such application, the third respondent is directed to consider the representation and pass appropriate orders. Further, the third and fourth respondents are directed not to call the petitioner to the police station on the basis of the rowdy sheet pending against the petitioner. However, this order will not stand in the way of respondents to call the petitioner for investigation if any case is registered for any cognizable offence against the petitioner. The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 08.11.2016 pln
