Heard the learned Counsel for the petitioner, the learned Government Pleader for Prohibition and Excise for the respondents No.1 and 2, and the learned Government Pleader for Home appearing for the respondent no.3.

It is stated by Counsel on both sides that the issue raised in this Writ Petition is covered by the Order, dated 20.12.2017, in W.P.No.43388 of 2017.

Therefore, for reasons alike, this Writ Petition is also disposed of, directing the petitioner to make an appropriate application before the Deputy Commissioner of Prohibition and Excise (2nd respondent herein) enclosing thereto a Fixed Deposit for Rs.1,30,000/ - (Rupees one lakh and thirty thousand only) drawn in favour of the 2nd respondent on any nationalized bank; and on such application being made by the petitioner, the subject stock i.e., 260 bags of black jaggery each containing 50 Kgs., seized in Cr.No.74 of 2018 on the file of the 3rd respondent, shall be given to the interim custody of the petitioner. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this Writ Petition, shall stand closed.
