HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION NOs.16626 and 16738 OF 2009 COMMON ORDER:
These two writ petitions are filed challenging condition No.8 of the tender notification bearing No.RC-480/A2/03, dated 03.08.2009 wherein it is stipulated that the intending ternder should deposit Rs.20 lakhs towards Earnest Money Deposit while submitting the tender form..
This Court on 13.08.2009, while admitting the writ petitions directed the respondents to receive the tenders of the petitioners subject to the condition of the petitioners paying Earnest Money Deposit of Rs.5 lakhs instead of Rs.20 lakhs as fixed in the terms and conditions of tender.
It is stated by both the counsel that in pursuance to the interim directions passed by this Court, petitioners' tenders were accepted, they were allotted work and the period of contract is also over, as such, the cause in the writ petitions does not survive for adjudication and the matters have become infructuous. Recording the above submission, both the Writ Petitions are dismissed as infructuous. No order as to costs.
