This Writ Petition, under Article 226 of the Constitution of India, is filed seeking to declare the action of the 2nd respondent in refusing to give permission in Lr.No.3/C21/20209/2019, dated 26.11.2019, for proposal for construction of building in Plot No.BII/166, B.K.Enclave, in Survey No.44/4, situated at Maqta Mahaboobpet Village, Serilingampally Mandal, Ranga Reddy District, as arbitrary and illegal and consequently direct the 2nd respondent forthwith to accept the application of the petitioner for grant of permission for construction of building in the aforesaid premises, without insisting on NOC from Revenue Department. 2.

Heard the learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for respondents 2 and 3.

Learned counsel for the petitioner would submit that the issue involved in this writ petition is squarely covered by the order of this Court, dated 27.07.2018 in W.P.No.26209 of 2018. The same is not disputed by learned Standing Counsel appearing for respondents 2 and 3.

Following the said order and for the reasons stated therein, this Writ Petition is also disposed of directing the respondents to receive and consider the petitioner's application for grant of building permission, without insisting upon the No Objection Certificate from the Revenue Department. It is made clear that the

petitioner shall comply with all other requirements prescribed by law. There shall be no order as to costs.

Registry is directed to enclose a copy of order, dated 27.07.2018 in W.P.No.26209 of 2018 to this order. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
