The present writ petition is filed to declare the action of the respondents in not prosecuting the case registered as FIR No.978 of 2015 on the file of the second respondent, as illegal and arbitrary. 2.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 05.12.2019, which is placed on record of this Court, would submit that after receiving the complaint, the matter was investigated into and examined witnesses and recorded their statements and also obtained PME report. After completion of the investigation, a charge sheet was filed before the V Additional District Judge, L.B.Nagar, and the case was numbered as S.C.No.608 of 2017 and is posted for fixing of trial schedule on 08.01.2020.

In the light of the aforestated submissions made on behalf of the second respondent, the grievance of the petitioner in this writ petition stands redressed and warrants no further orders from this Court. 5.
