THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD W.P. No.26937 of 2019 ORDER:
This writ petition is filed questioning the action of the respondents and their subordinates in trying to interfere into peaceful possession and enjoyment of the land of the petitioners by way of attempting to demolish the existing compound wall surrounded by the land of the petitioners, total admeasuring Acs.17.00 gts., under Sy.No.132/1, situated at Vattinagulapally village, Gandipet Mandal, Ranga Reddy District, without following due procedure contemplated under law and consequently to direct the respondents not to demolish or interfere with possession and enjoyment of the subject land of the petitioners without following the procedure contemplated under law.
It is the case of the petitioners that the respondents are interfering with the peaceful possession and enjoyment of the land of the petitioners by attempting to demolish the existing compound wall, which is surrounding the petitioners' subject land.
Heard Sri Y.Rama Rao, learned counsel appearing for the 2nd respondent, HMDA, who upon instructions, submits that presently HMDA authorities are not interested to acquire the land of the petitioners and thus the same may be recorded.
TA, J W.P. No.26937 of 2019 Heard Sri Ramakotaiah, learned Assistant Government Pleader for Revenue appearing for the respondents 3 and 4, who upon instructions, submits that the Revenue officials are not interfering with the subject lands.
In that view of the matter, this Court feels that ends of justice would be met directing the respondents not to interfere with the peaceful possession and enjoyment of the subject land of the petitioners, without following due process of law. Accordingly, this writ petition is disposed of. There shall be no order as to costs.
As a sequel, miscellaneous applications, if any pending, shall stand closed.
