THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM CIVIL MISCELLANEOUS APPEAL No.1609 of 2004 JUDGMENT:

When the matter was listed before this Court on 23.11.2017, as there was no representation on that day, the matter was directed to be listed on 30.11.2017. When the matter was listed on 30.11.2017, there was no representation on behalf of the appellants, as such, this Court directed the matter to be listed on 07.12.2017 under the caption 'For Dismissal'. Today also, when the matter is taken up, there is no representation on behalf of the appellants. A perusal of the proceeding sheet also discloses that on 19.02.2013, the appeal was dismissed for non-prosecution. However, the same came to be restored subsequently. In the circumstances, it is presumed that the appellants are not interested in prosecuting the appeal.
