No. 10547 of 2017 O R D E R:- (ORAL) (Per Hon'ble Sri Justice Suresh Kumar Kait) This writ petition is filed seeking a direction to the respondents to comply with the order dated 19.08.2016 passed by the Tribunal in O.A.No. 3135 of 2016 whereby the Tribunal, while disposing of the O.A., directed respondent Nos.1 to 3 therein to consider the request of the petitioner for compassionate appointment taking into consideration G.O.Ms.No. 118, dated 18.08.1999, and pass appropriate orders, within a period of eight weeks from the date of receipt of a copy of the order.
As stated by the learned counsel for the petitioner, the petitioner made a representation on 02.02.2008 to the Head Master, Government Upper Primary School, Narayanapur, who forwarded the same to a higher authority by making an endorsement thereon, however the endorsement does not clearly specify to which higher authority the representation has been forwarded. Thus, more than nine years have passed, however till date, the representation has not yet been decided.
In view of the above, this Court, in exercise of its jurisdiction under Article 226 of the Constitution of India,
SKK,J & Dr.SA,J WP_10547_2017 directs the 2nd respondent to consider the representation dated 22.02.2008 said to have been made by the petitioner and pass appropriate orders thereon, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is made clear that if the petitioner is aggrieved by the decision that may be taken by the 2nd respondent, she may agitate the same before appropriate forum.
With the above direction, the writ petition is disposed of. No order as to costs.
As a sequel, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous.
