THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION NO.23605 OF 2018 ORDER:

This Writ Petition is filed to declare the impugned proceedings dated 20.06.2018 issued by the second respondent as illegal, arbitrary and unconstitutional and to direct the respondents to consider the petitioner's claim for posting him to Government School of Nursing, Bodhan or UFWC, Nizambad in existing vacancies.

The petitioner was working in the office of the District Medical & Health Officer (DMHO), Armoor. In the recent transfers, the petitioner is transferred and posted to P.P. Unit, Nizambad. Petitioner challenges the said order. According to petitioner, the unit to which the petitioner is now transferred is last of the options given by him and that there are several vacancies in the other places opted by him and his request is not properly considered while some others' options are considered.

It is not in dispute that the petitioner has completed long service in the office of DMHO and is liable to be transferred and considering opted by him, he is transferred to the last of the units opted by him. The petitioner now seeks transfer on personal grounds to any of the three other places that were mentioned in his representation dated 20.06.2018.

Therefore, if the three other places opted by the petitioner are vacant and no other person is accommodated therein, the second respondent is directed to consider the request of the petitioner, as narrated in his representation dated 20.06.2018, and

to pass orders within four (4) weeks from the date of receipt of a copy of this order.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand closed.
