THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.19745 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking the following relief: ".... to issue an appropriate Writ order or direction more particularly in the nature of Mandamus, declaring the action of the respondents 6 & 7 in conducting the Panchanama dated 08-05-2017, as illegal, arbitrary and violation of Rule 7 (4) of the A.P. Scheduled Areas Land Transfer Regulation Rules-1969 and principles of Natural Justice, and consequently set aside the same and further direct the respondents, not to dispossess the petitioner from the land in Sy.No.902 to an extent of Acs.2-03 gts. at Papakollu village of Julurpad Mandal, Bhadradri Kothagudem (formerly part of Khammam) District, and to pass such other order or orders as the Hon'ble Court deems fit and proper in the circumstances of the case and in the interest of justice." Heard the learned counsel for the petitioner and learned Government Pleader for Social Welfare appearing for the respondents. With their consent, the Writ Petition is disposed of at the admission stage itself.

It is represented by the learned counsel for the petitioner that the issue involved in this writ petition is squarely covered by the order of this Court, dated 07.06.2016, rendered in W.P.No.17570 of 2016 and batch. The same is not disputed by the learned Government Pleader.

In that view of the matter, following the said order, this Writ Petition is disposed of directing the appellate authority i.e., The District Collector, Bhadradri Kothagudem District, (respondent

No.2), to dispose of the appeal filed by the petitioner, against the order dated 02.09.2013 passed in Case No.109/2013/JLP, if the same is still pending, as early as possible, preferably within a period of four to six weeks from the date of receipt of a copy of this order. However, till such time, the respondents shall not dispossess the petitioner from the subject property. Miscellaneous petitions pending in this writ petition, if any, shall stand closed.
