HON'BLE SRI JUSTICE U.DURGA PRASAD RAO I.A.No.4 of 2018 in Crl.P.No.7210 of 2018 and Crl.P.No.7210 of 2018 COMMON ORDER:

The defacto complainant and her counsel Sri N.B.Sudarshan are present.

Petitioners/accused and their counsel Sri Bethi Venkateshwarlu are present. Both the parties are identified by their respective counsel.

2) Heard both sides and perused the petitions.

3) The defacto complainant lodged a complaint before the Protection Officer and the same was registered as DVC No.68 of 2018 on the file III Metropolitan Magistrate, City Criminal Court, Hyderabad for the offences under Sections 20 and 22 of Domestic Violence Act. Prior to it, she lodged a complaint against the 1st petitioner/1st respondent before Women Police Station, CCS, Hyderabad and the same was registered as Cr.No.33 of 2016 and police after investigation filed charge sheet for the offences under Sections 498A, 406, 420 and 506 IPC which was taken cognizance and registered as C.C.No.482 of 2016 by XIII Additional Chief Metropolitan Magistrate, Hyderabad.

4) At this stage, petitioners/accused filed Crl.P.No.7210 of 2018 before this Court to quash the proceedings against them in DVC No.68 of 2016.

5) When the matter is pending, both parties filed I.A.No.4 of 2018 seeking permission of this Court to compound the offence. In the said petition, it was mentioned that both parties have amicably settled all their disputes at the intervention of elders. It is further stated that A1 and complainant filed OP No.517 of 2018 before the file of Family Court, Hyderabad for divorce and the same is pending. It is also stated that petitioner/accused agreed to pay Rs.30 lakhs to the complainant towards permanent alimony and out of which, he already paid Rs.10 lakhs on 08.05.2018 drawn on Union Bank of India, Gayathri Nagar Branch, Hyderabad and today i.e. on 11.07.2018, DD No.656692 for an amount of Rs.10 lakhs drawn on Union Bank of India, Gayathri Nagar Branch, Hyderabad was handed over to the complainant in the Court. They would submit that in view of settling all their disputes at the intervention of elders, they are proposing to compound the offences involved in DVC No.68 of 2016 and hence permission may be granted to them.

6) On enquiry by this Court, both the parties affirmed the contents in joint memo. The offences alleged in DVC No.68 of 2016 are under Sections 20 and 22 of DV Act. It shall be noted, the instant case is a matrimonial dispute and purely a private one and the same has no impact on the society. Further, from the submission of both the parties, they have settled all their disputes and pending cases at the intervention of elders.

8) With the above observations, I.A.No.4 of 2018 is allowed and the parties are permitted to compound the offences involved in DVC No.68 of 2016 on the file of III Metropolitan Magistrate, City Criminal Court Hyderabad. Consequently, the Criminal Petition No.7210 of 2018 is allowed and the proceedings in DVC No.68 of 2016 are quashed against petitioners/accused and they are acquitted of the offences for which they have been charged. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
