THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10944 of 2025 ORDER:
Seeking the Court to enlarge the petitioners who is arrayed as accused Nos.1 and 2 in Crime No.62 of 2025 of Sirikonda Police Station, Adilabad, on bail, the present Criminal Petition is filed. 2.
The brief facts of the case are that, on 20.07.2025, the defacto complainant lodged a report with the police stating that her elder daughter (deceased) had been in a relationship with Accused No.1. Although the family initially disapproved, they consented to the marriage after consulting community elders. The marriage was solemnized on 11.05.2025 according to caste traditions. For the first month, the daughter was treated well. Thereafter, she was subjected to continuous mental and physical harassment by her husband, mother-in-law, and sisters-in-law. They accused her of manipulating their son into marriage, expressed hostility, and frequently abused and assaulted her. Around 15 days before the incident, her husband, while intoxicated, demanded a Pulsar motorcycle as dowry, claiming it had been promised. He pressured her to obtain it from the complainant. Her daughter disclosed ongoing abuse and threats to leave the house. When the
complainant confronted the in-laws, they dismissed her concerns. Despite assuring them that the bike would be arranged within a month, the harassment persisted. On 19.07.2025, unable to bear the abuse, the daughter consumed Monosil pesticide at her grandmother's vacant house and returned to her in-laws, where she began vomiting. Her husband and younger brother took her to RIMS Hospital, Adilabad. She died during treatment later that evening. The complainant alleges that her daughter died by suicide due to sustained harassment and abuse by her husband and in-laws, and requests appropriate legal action against the accused. Based on the said complaint, the police registered a case vide Crime No.62 of 2025 for offence punishable under Section 80 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

Heard Mr. Soma Ravi Kiran Reddy, learned counsel appearing for the petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent-State.

Learned counsel for the petitioners submitted that the petitioners are innocent and have not committed any offence and that the marriage between the deceased and accused No.1 was a love marriage, solemnized without any dowry. Although the
deceased's family initially opposed the union, the accused's family proceeded with the marriage and that there was no demand for additional dowry and no harassment in that regard. He further submitted that accused No.1 was arrested on 21.07.2025 and accused No.2 on 12.08.2025, and that the material part of the investigation has been completed. Therefore, prayed the Court to grant bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners by contending that the allegations are serious in nature, as the deceased committed suicide within two months of marriage due to alleged harassment for additional dowry and that the investigation is in progress and if the petitioners are released on bail, at this stage, he may tamper with the evidence and may threaten the witnesses. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it is noted that Accused No.1 was arrested on 21.07.2025 and Accused No.2 on 12.08.2025. As per the remand case diary, the material portion of the investigation has been completed, including the examination of sixteen witnesses. Considering the overall facts and
circumstances of the case, this Court finds it appropriate to grant bail to the petitioners, subject to the following conditions: i.
The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each, with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate at Boath, Adilabad District.
ii.
The petitioners shall appear before the concerned SHO at 11:00 A.M., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.
iii.
The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
