THE HONOURABLE SMT JUSTICE K. SUJANA CRIMINAL PETITION No.10860 of 2025 ORDER:
This Criminal Petition is filed before this Court for grant of pre-arrest bail to the petitioners who are arrayed as accused Nos.3 and 4 in Crime No.62 of 2025 before the Sirikonda Police Station, at Adilabad District, registered for the offences punishable under Section 80 r/w Section 3 (5) of BNS.

The case of the prosecution is that on 20.07.2025 at 10.00 hours the de-facto complainant lodged a report before the police stating that her elder daughter's marriage was performed with accused No.1 on 11.05.2025, at 11.00 hrs. For the first month, her daughter was treated well by her sonin-law and his family. However, after that, her mother-in-law, her husband, and her two sister-in-laws started harassing her daughter mentally and physically and also they abused and beat her frequently. Later, accused No.1 harassed her daughter for bringing a Pulsar bike from her mother's house. When the de-facto complainant assured them that she would
arrange for the bike within a month, they didn't listen. She brought her daughter to her home, kept her with them for two days and consoled her. After going back, her daughter was continued to be harassed by her in-laws both mentally and physically. Unable to bear the continuous abuse, her daughter took a bottle of Monosil pesticide and went to her Grandmother's house and since no one was at home, she consumed the poison in the bathroom. She then returned to her in-laws' house and began vomiting. Noticing this, her son-in-law and her younger brother took her to RIMS Hospital in Adilabad and while undergoing treatment, she passed away on 19.07.2025, at 21.11 hrs as confirmed by the doctor. Hence, she requested for taking necessary action. On receipt of the said complaint, the Police registered case against the petitioners for the offences as alleged. Aggrieved thereby, this Criminal Petition is filed seeking anticipatory bail of the petitioners.

Heard Sri Soma Ravi Kiran Reddy, learned counsel for petitioners as well as Sri Arun Kumar Doddla, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for petitioners submitted that the accused Nos.3 and 4 are sister-in-laws' of the deceased and the petitioners are innocent of the alleged offences. It is further submitted that there are no serious allegations leveled against these petitioners and they have never harassed the deceased and no such dowry was demanded by them at the time of marriage of the accused No.1 and the deceased. Therefore, he prayed the Court to grant pre-arrest bail to the petitioners by allowing this criminal petition. 5.
On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners stating that the allegations leveled against the petitioners are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioners does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners herein are accused Nos.3 and 4, who are sister-in-laws of the deceased and further, there are
no serious allegations leveled against these petitioners. Therefore, this Court deems it fit to grant pre-arrest bail to the petitioners, subject to compliance of the following conditions: i.
The petitioners shall surrender before the Station House Officer, Sirikonda Police Station, at Adilabad District, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail, on petitioners executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
