O R D E R
This criminal petition is filed under Section 482 of Cr.P.C. to quash the proceedings in FIR/Crime No.77/2016 on the file of Station House Officer, Suryapet Rural Police Station, Suryapet, Nalgonda District, registered against the petitioner/accused No.2 for the offences punishable under Section s 379 read with 109 IPC and Section 3 of PDPP Act.
Heard the counsel for the petitioner/accused No.2 and the learned Additional Public Prosecutor, representing the State.
The learned counsel for the petitioner submitted that the lorry bearing No. AP 29 TB 2737 was seized by the police on the allegations of transporting sand illegally without any valid documents and permit. He further submitted that the driver of the lorry A-1, confessed that the lorry belongs to the petitioner. He stated that the petitioner is not the owner of the crime vehicle and the same is evident from the registration certificate of the crime vehicle and that a false case is foisted against the petitioner. Therefore, he sought to quash the proceedings. Having regard to the facts and circumstances and the submissions of the learned counsel for the petitioner, the criminal petition is disposed of directing the petitioner/A-2 to produce all the relevant documents before the Investigating Officer and the Investigating Officer, shall consider the same and conduct the investigation in the matter in accordance with law.
