This writ petition is filed challenging the action of respondent Nos.1 to 5 in taking forceful possession of land in excess notified land as per Acquisition Proceedings No.A/8930/2013, dated 21.09.2017.

The grievance of the petitioner is that though the respondents proposed to acquire her land to the extent of Ac.1-051⁄2 guntas in Sy.No.79, situated at Kyathanpally Village, Mandamarri Mandal, Adilabad District, for the purpose of construction of Road Over Bridge, now they are forcing her to leave more land than the actual acquired land i.e., Ac.1-20 guntas instead of Ac.1-051⁄2 guntas. 3.

Heard learned counsel for the petitioner and learned Government Pleader for Land Acquisition representing the respondents.

The Government Pleader for Land Acquisition submits that the contention of the petitioner that the respondents are forcing her to leave more land than the actual acquired land i.e., Ac.1-20 guntas instead of Ac.1-051⁄2 guntas, is not correct. He furnished copy of panchanama dated 19.03.2019, which shows that an extent of land admeasuring Ac.1-051⁄2 guntas belonging to the petitioner was acquired.

To put a quietus to the dispute, this Court is inclined to direct the second respondent to take steps to cause a survey and demarcate the land which was acquired from the petitioner within a period of four weeks from the date of receipt of a copy of this order and pay the compensation to the petitioner to the extent of land acquired, as per the survey report, in accordance with law. Miscellaneous petitions pending, if any, shall stand closed. No costs.
