THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.14276 OF 2016 ORDER:

The petitioners/A1 to A3 filed this Criminal Petition under Section 482 Cr.P.C. praying to call for entire records of F.I.R.No.43 of 2016, dated 01-06-2016 on the file of the Station House Officer, Rajapeta Police Station, Nalgonda District and quash the same. Heard the learned counsel for the petitioners and the learned Public Prosecutor and perused the material available on record. Having regard to the facts and circumstances of the case, interim custody 20 bags of rice (PDS) (10 Qtls.) each bag 50 kg seized under F.I.R.No.43 of 2016 on the file of the Rajapeta Police Station, Nalgonda District, shall be given to the petitioner No.1 - accused No.1 on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) together with one surety for the like sum to the satisfaction of the trial Court.

Further, interim custody of Mahindra Jeetho Trailor bearing No.TS 09 7 T/R 27 seized under F.I.R.No.43 of 2016 on the file of the Rajapeta Police Station, Nalgonda District, shall be given to the petitioner No.1 - accused No.1 subject to final orders to be passed in the criminal case in connection with the subject crime, on his executing a personal bond for a sum of Rs.1,00,000/- (Rupees One Lakh only) together with one surety for the like sum to the satisfaction of the trial court and also on production of original R.C. book.

petitioner shall not alienate the vehicle, shall not change the physical features of the same till the disposal of the criminal case and further he shall undertake to produce the vehicle as and when required by the Court below. However, it is made clear that the present order will not stand in the way of confiscation proceedings, if any, already passed. Further, this order does not preclude the authorities from passing any confiscation proceedings.

Accordingly, the Criminal Petition is disposed of.

Consequently, the miscellaneous petitions pending, if any, shall stand closed.
