HON'BLE JUSTICE G. SRI DEVI CRIMINAL PETITION No.79O2 of 2Ot9 ORDER:
Tl.ris Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioner, who is Accused, seeking anticipatorS, bail in Crime No.761 of 2019 of Mailardevpally Police Station, Ranga Reddy District, registered for the offence punishable under Section 498-,{ of IPC.
The case of the prosecution is that on 31.1O.2OI9 the complainant has lodged a complaint before the police stating that her marriage with the petitioner \\'as performed 19 years back and during the matrimonial life, they '*'ere blessed with three children and thereafter since one year, the petitioner had illegal relationship with another lady and started harassing her physically and mentally and hence requested to take necessary action against him. Basing on the said complaint, the police registered the above Crime No.761 of 2Ol9 for the aforesaid offence against the petitioner.
Heard learned counsel for the pe titioner/ Accused and the learned Additional Public Prosecutor appearing for respondent - State. Perused the material on record. Learned counsel for the petitioner contends that the petitioner is innocent of the alleged offence and a false case has been foisted against him at the instance of the defacto complainant. It is also contended that since the
\ GSD, J Crl.P.No.7902 of20l9 date of their marriage, the petitioner and the defacto complainant were living happily and out of wedlock, they were blessed with three children, who are aged about 17, 15 and 13 years, respectively. It is also contended that the allegations are made against the petitioner only with a malafide intention. It is contended that the petitioner is ready to abide by any of the conditions imposed by this Court and would cooperate with the investigation, if he is released on anticipatory bail in the event of his arrest in connection with the aforesaid crime.
On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above peti tion.
Looking into the nature of allegations made against the petitioner and also keeping in view the facts and circumstances of the case, without adverting to the merits of the case, I am inclined to grant anticipatory bail to the petitioner/ Accused by imposing some conditions. In the result, this criminal petition is allowed and the petitioner/Accused is directed to be released on bail in the event of his arrest in connection with Crime No.761 of 2019 of Mailardevpally Police Station, Ranga Reddy District, on his executing a personal bond for Rs. 15,000/- (Rupees fifteen thousand only) with two local sureties for a like sum each to the satisfaction of the said Station House Officer and subject to the condition that the petitioner/ Accused would cooperate with the a
Crl P.N0.7902 of20i9 Investigation Agency and would report before the above Poiice Station, on every Sunday between 10-00 a.m. and I 5-0O p.m. till completion of investigation and filing of charge sheet, rvhichever is earlier.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
