THE HON'BLE SRI JUSTI CE A.V.SESHA SAI W.P.No.23558 of 2018 O R D E R:

A notice bearing Roc.No.10872/2015/G2, dated 22.06.2018, issued by the Commissioner, Nellore Municipal Corporation, Dargamitta, Nellore under Section 636 of the Hyderabad Municipal Corporation Act, 1955, asking the petitioner to vacate the subject premises is under challenge in the present writ petition.

Even according to the petitioner, consequent upon the issuance of the said notice, the Municipal Corporation authorities have demolished the structures.

A reading of the affidavit filed in support of the writ petition indicates in clear and vivid terms that the petitioner herein eventually is asking for damages. In the considered opinion of this Court, this Court under Article 226 of the Constitution of India cannot assess the quantum of damages as pleaded by the petitioner herein.

In view of the above, writ petition is disposed of, keeping it open for the petitioner herein to approach the competent forum of law. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs.
