HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.10582 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner and the Government Pleader for Civil Supplies for the State of Andhra Pradesh.

2. This writ petition is filed seeking writ of Mandamus declaring the action of the 2nd respondent-the Joint Collector, Srikakulam, Srikakulam District, in not disposing the stay petition filed by the petitioner in the Appeal against the cancellation orders passed by the 3rd respondent in Rc.No.5566/2014/CS dated 13.03.2015, as illegal and arbitrary.

3. After issuing a show cause notice alleging certain irregularities and conducting enquiry into the said irregularities, the 3rd respondent-Revenue Divisional Officer, Srikakulam, vide order dated 13.03.2015 cancelled the authorisation of the petitioner's fair price shop. Against the said order, the petitioner filed an appeal before the 2nd respondent, which is now pending. In the said appeal, the petitioner also filed an application seeking stay of the order of the Revenue Divisional Officer. It is submitted that in spite of filing of the stay petition, no orders have been passed thereon till today.

4. In these circumstances, the 2nd respondent-Joint Collector, Srikakulam, Srikakulam District, is directed to dispose of the appeal and the stay petition filed therein, within a period of eight (8) weeks from the date of receipt of a copy of this order.

5. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
