Heard learned counsel for the petitioner and learned Government Pleader for respondents.
This Writ Petition is filed challenging the action of the respondents in not allowing construction of the single line bridge at Mamillakodu channel at 1.500 Kms., situated within the limits of Pamarru Gram Panchayath, Pamarru Mandal, Krishna District as per the sanctioned plan under permission of the second respondent. It is the case of the petitioner that the third respondent was preventing him to work even though he submitted representation dated 28.05.2015 and reminder on 03.06.2015.
This Writ Petition was taken up for hearing on 08.06.2015. Learned Government Pleader submits that the petitioner is deviating from the sanctioned plan and specifications. However, learned counsel for the petitioner submits that it is confining the work to the specifications and he is ready to give an undertaking to confine himself to the sanctioned plan and specifications. It appears that the third respondent has not issued any written order. In the circumstances, the Writ Petition is disposed of directing the third respondent not to interfere with the construction activity undertaken by the petitioner on the orders of the second respondent, without following due process of law, so long as the petitioner confines himself to the specifications and sanctioned plan. No costs. Miscellaneous petitions, if any, pending shall stand closed.
