THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.16831 OF 2017 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, came to be filed seeking to declare the action of respondents 2 and 3 in not taking any action against respondents 4 to 8 even after registration of a crime in FIR No.24 of 2017 of Kodimial Police Station, Jagial District, as illegal and arbitrary.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Home. With their consent, the Writ Petition is disposed of at the stage of admission itself. Since this Court is not going into the merits of the case, there is no necessity to issue notice to respondent Nos.4 to 8. When the matter is taken up for hearing, the learned AGP would submit that A.1 was arrested on 28.03.2017 and produced before II Additional Judicial Magistrate of First Class, Jagtial. Insofar as other accused are concerned, learned AGP would submit that so far 7 witnesses are examined and proposals were sent to concerned Superintendent of Police seeking permission to arrest A.2 and A.3.

Having regard to the above, it cannot be said that respondents 2 and 3 are not investigating into crime No.24 of 2017. Since the crime is registered only in the month of March, 2017, and taking into consideration the progress in investigation,

as reported by the AGP, respondents 2 and 3 are directed to complete investigation, as early as possible, and file a final report. Accordingly, the Writ Petition is disposed of.
