THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.7869 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioner/A4 in Crime No.500 of 2022 on the file of S.R.Nagar Police Station, Panjagutta Division, Hyderabad, registered for the offences punishable under Sections 8(c) read with 22(C) and 27 of the NDPS Act, 1985.

Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The S.R.Nagar Police arrested this petitioner and others for being in possession of MDMA Drug.

Specifically, the case against this petitioner is that he was found in possession of 10 grams of MDMA Drug. 5.

Learned Counsel for the petitioner submits that the petitioner is a B.Tech. graduate and working in a private company; and that the allegations leveled against the

petitioner are false and no seizures were affected. Further, the charge sheet is already filed after completion of investigation. 6.

Learned Additional Public Prosecutor would submit that there are no cases pending against this petitioner. 7.

Keeping in view that investigation is already complete, the petitioner can be granted the relief of bail subject to the following conditions:

i) The petitioner/A4 shall execute personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for a like sum each to the satisfaction of III Additional Chief Metropolitan Magistrate at Hyderabad.

ii) After release, the petitioner/A4 shall appear before the concerned Court every day before the concerned Court.

iii) The petitioner/A4 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 8.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
