THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.7825 OF 2022 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner who is arrayed as Accused No.8 in the event of his arrest in Crime No.725 of 2022 on the file of Station House Officer, Hayathnagar Police Station, Rachakonda Commissionerate registered for the offences punishable under Sections 419, 420, 467, 468 and 471 read with Section 34 of Indian Penal Code.

Heard learned counsel for the petitioner/Accused No.8 and learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The case against the petitioner is Accused No.8 is alleged to have purchased the land of the de facto complainant's father from Accused No.5, the said documents in favour of Accused No.5 was a fabricated document, for the said reason this petitioner was also arrayed as an accused.

Learned counsel for the petitioner submits that he himself is a victim in the said sale transaction and he was induced by Accused No.5 into purchasing the said property, as such, sought the relief of anticipatory bail.

On the other hand learned Assistant Public Prosecutor opposed the bail application saying that it is a case of criminal conspiracy and the same cannot be decided whether the petitioner complicit in the said offence or not.

Since all the documents which are registered documents can be investigated by the police. Whether this petitioner was a victim in the hands of Accused No.5 or not is the subject to outcome of the investigation. In the said circumstances, this petitioner can be granted the relief of anticipatory bail.

Accordingly, the Criminal Petition is allowed and the petitioner/Accused No.8 shall be enlarged on bail in the event of his arrest subject to the following conditions:

i) The petitioner/Accused No.8 is directed to surrender before the Station House Officer, Hayathnagar Police Station, Rachakonda Commissionerate within ten days from today, and on such

surrender, he shall be enlarged on bail on his executing personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with two sureties to the like sum each, to its satisfaction. ii) On such release, the petitioner/Accused No.8 shall appear before the said Station House Officer on every Monday between 10.00 a.m. and 05.00 p.m. for a period of eight (08) weeks and thereafter as and when required.

iii) The petitioner/Accused No.8 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C. Miscellaneous applications, pending if any, shall stand closed. _____________ K.SURENDER, J Date: 02.09.2022 ns
