THE HONOURABLE SMT. JUSTICE K. SUJANA CRIMINAL PETITION No.10854 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.1490 of 2025 of Gachibowli Police Station, Cyberabad Commissionerate.

The brief facts of the case are that on 07.07.2025 a petition was received from the de facto complainant in which she stated that she came into contact with one Chinta Reddy Nagarjuna Reddy, now residing in the United States, during 2019-2021. Their friendship grew closer, and in 2020 he expressed his wish to marry her, giving assurances and support. In the year 2021, he clearly proposed marriage and continued meeting her frequently. She alleged that he established sexual relations with her against her will at times, assuring her of marriage, and this continued from December 2021 onwards. On 12.06.2025, after going to the United States, he refused to marry her, thereby cheating her. She

stated that she suffered emotional trauma, sexual exploitation, and harassment for more than 3.5 years on the false promise of marriage.

Heard Smt. Cherukuri Anuradha, learned counsel appearing on behalf of the petitioner as well as Sri D. Arun Kumar, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioner submitted that the relationship between the petitioner and the complainant was mutual and consensual, without any coercion or fraudulent intent and that the complaint only reflected the breakdown of a long personal relationship, and no act alleged was nonconsensual. He further submitted that the FIR was filed belatedly on 07.07.2025, just after the petitioner left for the United States, showing mala fide and retaliatory intent and that a failed relationship or unfulfilled promise of marriage could not attract criminal liability unless fraudulent intent from the beginning was proved, which was absent here. He contended that the complainant had earlier issued a legal notice, and before the reply time expired, she lodged the FIR,

also dragging the petitioner's sister and relatives without any specific allegations. The grievance, at best, was civil in nature and could not be converted into a criminal case. Therefore, he prayed the Court to grant pre-arrest bail to the petitioner by allowing this criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the bail stating that the allegations leveled against the petitioner are serious in nature. He further submitted that the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

In the light of the submissions made by both the learned counsel and upon a perusal of the material available on record, the allegation against the petitioner is that, under the promise of marriage, he sexually exploited the de facto complainant, with whom he has been in a relationship since 2019. The record shows that they were in love with each other, but later disputes arose between them. Considering the prolonged relationship between the parties and the overall

facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:

i.

The petitioner shall surrender before the Station House Officer, Gachibowli Police Station, Cyberabad Commissionerate, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/- with two sureties, for the like sum each.

ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
