THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITON No. 4345 OF 2007 ORDER:
This writ petition is filed seeking a Mandamus to declare the action of the respondents in not appointing the petitioner as Anganwadi worker of Erraguntla Village, Garladinne Mandal. The case of the petitioner is that though she is having all the requisite qualifications, she was not selected in the interview that was held on 08.11.2006 on account of the pressure from the local MLA. Counter affidavit is filed specifically denying the allegations. Apart from that, the second respondent had also categorically stated that the interview was conducted by a Committee, wherein the petitioner was found not eligible. As a matter of fact, no selection was made as two other candidates viz., S.Radha and K.Gowtami were found out ineligible on account of they being under aged. I have perused the record. Though a vague allegation that there is a specific pressure is brought, the aspects as to whether from whom the said pressure is brought; from what circumstances; and on whose benefit, are not forthcoming from the affidavit.
Further, the fact that two other candidates also came to be rejected considering they being ineligible on account of they being under age, itself disclose that selection process by the Committee was not fraud in any manner.
In those circumstances, there being no material to support the mala fides and the petitioner having been found to be not eligible, the decision of the respondent in not appointing the petitioner cannot be found fault. There being no merit in the writ petition, the same is liable to be dismissed.
Accordingly, the writ petition is dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
