THE HON'BLE SRI JUSTICE C.V.NAGARJUNA REDDY CIVIL REVISION PETITION No. 5070 OF 2016 DATED 21ST OCTOBER, 2016 Between:

Laveti Laxman Rao ...

Petitioner AND Pudi Sattibabu and others ...

Respondents Counsel for the petitioner :

Sri Venkateshwar Varanasi Counsel for the respondents :

-- THE COURT MADE THE FOLLOWING

CVNR, J.

crp_5070_2016 ORDER:

The auction purchaser of a property in Court sale in pursuance of the decree granted in O.S.No. 212 of 2012 filed this civil revision petition feeling frustrated by non-disposal of E.A.No. 103 of 2011 filed by him in E.P.No. 123 of 2007 in O.S.No. 212 of 2012 on the file of the Court of Principal Junior Civil Judge, Yellamanchili (for short, 'the lower Court'). 2.

A perusal of the docket proceedings shows that the E.A. has undergone countless number of adjournments commencing from July, 2012. Many of the docket endorsements show that the application is adjourned with the cryptic reason "For Hearing". On perusing the docket proceedings, I do not find any semblance of justification for the lower Court for needlessly adjourning the application over a period of more than four years. Such conduct on the part of the Court frustrates the litigants and make them lose faith in the judicial institution itself. The lower Court is directed to dispose of the E.A., as expeditiously as possible and not later than one month from the date of receipt of a copy of this order, after hearing all the parties. 3.

Subject to the above direction, the civil revision petition is disposed of. 4.

As a sequel to disposal of the civil revision petition, C.R.P.M.P.No. 6567 of 2016 shall stand closed as infructuous.
