HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.22899 OF 2016 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in increasing the width of the road in the petitioners' agricultural lands in Survey Nos.191/27, admeasuring Ac.3.00 guntas, situated at Kollur Village, Ramachandrapuram Mandal, Medak District, as illegal and arbitrary and violative to the right to fair compensation and transparency in land acquisition, rehabilitation and resettlement Act, 2013 and for a consequential direction to the respondents to pay the compensation to the petitioners.

The case of the petitioners is that in the year 1999 the local gram panchayat authorities had laid a road of 15" feet passing through petitioners' patta without any notice and compensation and when they objected and protested, the respondents promised them to pay compensation later, but till today they have not paid any compensation to the petitioners. It is further stated that again in the year 2015 the local Gram Panchayat authorities extend the road 50" feet in width through petitioners' patta without paying any compensation. As such, the petitioners approached the respondent authorities for compensation, but, no action is being taken by the respondents. It is also stated that the authorities in collusion with other authorities are trying to laid down the 110" feet road in order to help to the real estate industries in the surrounding localities and more specially to M/s.Rajapushpa Properties Private Limited, by misusing official powers.

Heard learned counsel for the petitioners, learned Government Pleader for Revenue and Sri G.Narender Reddy,

learned counsel for the 6th respondent.

Learned Government Pleader for Assignment produced written instructions from the Tahsildar, Ramachandrapur Mandal stating that in respect of acquisition of lands for the purpose of laying 110" feet road, preliminary demarcation is going on in Survey No.191 of Kollur Village and after completion of demarcation work, if it is found that the petitioners' lands are affected, necessary action would be initiated to procure the lands following the due procedure.

Recording the aforesaid submission made by the learned Government Pleader that they will follow due procedure as envisaged under law while acquiring the petitioners' lands, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
