THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRIMINAL PETITION No.9330 of 2016 ORDER:
This petition under Section 482 Cr.P.C., is filed by the petitioners/A.2, A.4 to A.6 seeking to quash the proceedings in Crime No.123 of 2013 of Ramagundem Police Station, Karimnagar District, registered for the offence punishable under Section 420 IPC against them.
2. The de facto complainant filed a complaint against the petitioners alleging that the petitioners took his lorries on lease basis for a monthly rent of Rs.40,000/- to transport iron to Visakhapatnam. But so far the petitioners neither returned the lorries nor paid the lease money and cheated the de facto complainant.
3. Heard learned counsel for the petitioners/A.2, A.4 to A.6 and learned Additional Public Prosecutor representing the State.
4. Learned counsel for the petitioners submit that the petitioners/A.2, A.4 to A.6 were remanded to judicial custody and obtained bail on some conditions. He further submits that the learned Magistrate is insisting for appearance of the petitioners even though charge sheet is not filed.
5. In that view of the matter, the Criminal Petition is disposed of directing the learned Magistrate not to insist for the presence of petitioners/A.2, A.4 to A.6 till charge sheet is filed and summons are issued. Learned Magistrate shall obtain bonds from the petitioners to appear on being summoned, after charge sheet is filed.
6. With the above direction, the Criminal Petition is disposed of.
7. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
