HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.39810 of 2016 ORDER:

Learned counsel for petitioners confines the prayer for directing respondent No.2 to dispose of representation, dated 15.02.2016 (made to the District Collector, Ranga Reddy) and pass appropriate orders thereon.

I have perused the representation, dated 15.02.2016. From the material available on record, it appears, respondent No.6, a local body, is expected to conform to rules, regulations and byelaws. If it deviates from rules etc., when examining the construction undertaken by respondent Nos.7 and 8, the same sets a bad precedent in the entire Gram Panchayat. The Gram Panchayat henceforth will not have moral ground to proceed against unauthorised constructions. This Court is of the view that the grievance is to be factually verified.

Hence, the petitioners are given liberty to represent to respondent Nos.2 and 3 on the alleged unauthorised and illegal construction undertaken by respondent Nos.7 and 8. The complaint is examined and appropriate decision within the four corners of law after hearing respondent Nos.7 and 8 is taken. Respondent Nos.2 and 3 are directed to complete this exercise within six weeks from the date of receipt of copy of this order.

Writ petition is accordingly disposed of.
