HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.25368 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of mandamus declaring the action of respondent Nos.1 to 5 in allowing respondent No.6 to do illegal activities including de-silting of Buchiraju Dharma Cheruvu (tank) of Movva Village and Mandal in Krishna District as illegal, arbitrary and consequently cancel the work order of de-silting of tank issued by respondent No.3 in favour of respondent No.6.
2. Heard the learned counsel for petitioner, learned Assistant Government Pleader for Irrigation and Command Area Development (A.P.) appearing for respondent Nos.1 and 3, learned Government Pleader for Revenue (A.P. ) appearing for respondent No.2, and learned Government Pleader for Home (A.P.).
3. The contention of learned counsel for the petitioner is that sixth respondent, who is a contractor, has been doing illegal activities including de-silting of Buchiraju Dharma Cheruvu and selling the silt to third parties, without using the same for the Government buildings under Neeru-Chettu programme. He further submitted that in spite of the fact that the matter was reported to the Panchayat Secretary, no action has been taken against the sixth respondent. He also submitted that the petitioner made representation dated 23.5.2016 to the second respondent to take action against the sixth respondent and others but of no avail.
4. The only relief sought by the petitioner is that the second respondent may be directed to take necessary action on the representation made by the petitioner on 23.5.2016 in accordance with law.
5. Taking into consideration the facts and circumstances of the case, the second respondent is directed to take appropriate action on
the representation of the petitioner dated 23.5.2016, as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.
6. With the above direction, the writ petition is disposed of. Miscellaneous petitions, if any pending in this writ petition shall stand closed.
