THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.30577 OF 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India for the following relief:
"to issue, a writ of Mandamus declaring the action of the respondent Nos.2 & 3 in not considering the complaint dated 06.08.2015 made by the petitioner against the 4th respondent as illegal, improper, unjust, arbitrary, contrary to law and also violation of Article 21 of Constitution of India and further direct the 3rd respondent to register the case and investigate the case by filing final report and pass such other order or orders in the interest of justice ."
2. When the matter is called today, written instructions dated 30.09.2015, furnished by the Sub Inspector of Police, Guntakal Rural Police Station, Guntakal, Anantapur District, have been placed on record by the learned Government Pleader for Home and to the extent of relevancy, the said instructions read as under: "On 6.8.2015 at 5 p.m. the complainant Uddula Meenakshi did not came to ontakal Rural PS and did not gave any complaint. On 11.09.2015 complaint petition of Uddula Meenakshi was endorsed by the Superintendent of Police, Ananthapuramu vide C.No.825/G2/2015 of the Superintendent of Police, Ananthapuramu, on receipt same, I perused the petition and found that the petition contents is having ingredients of cognizable offence, hence a case was registered vide Guntakai Rural PS, Cr.No. 88/2015 u/s 448, 354, 447, 427 r/w 34 IPC on 11.9.2015 at 5.30p.m against the accused concerned and tookup investigation. Case is U.I to exam some more witnesses and arrest of accused. The copy of F.I.R. is here with enclosed for favour of the kind perusal."
3. On noticing the said instructions, learned counsel for the petitioner requested this court to dispose of the writ petition by recording the written instructions.
4. In view of the above, writ petition is disposed of, by recording the written instructions dated 30.09.2015, furnished by the Sub Inspector of Police, Guntakal Rural Police Station, Guntakal, Anantapur District.
