Thotapalli Sridevi, And 2 Others, v. T. Kanarao, And Another,
HONOURABLE SRI J USTICE N. BALAYOGI CRIMINAL PETITION No. 4894 OF 2011 ORDER:
Learned Counsel for the petitioners is present and seeks adjournment.
As seen from the proceeding sheet, the petitioners obtained stay on 22.6.2011 and thereafter to till date, the learned Counsel appearing on their behalf, except on one or two occasions, took adjournment on all the dates of hearing, i.e. 21.09.2017, 12.10.2017, 25.10.2017, 08.11.2017, 15.11.2017, 29.11.2017, 06.12.2017, 11.12.2017, 12.12.2017, 02.01.2018, 05.01.2018 and 25.01.2018. Today also, the learned Counsel for the petitioners is not ready and requested time. Thus it emerges that the petitioners are not interested to argue the matter. In the circumstances, this Court has no option except to dismiss the criminal petition for non prosecution.
Accordingly the Criminal Petition is dismissed for nonprosecution. Miscellaneous petitions pending consideration if any in the Criminal Petition shall stand closed in consequence. ------------------------------------- JUSTICE N. BALAYOGI DATED 1st February, 2018.
