THE HON'BLE SRI JUSTICE P.NAVEEN RAO CIVIL REVISION PETITION NO.3930 OF 2018 ORDER:

Petitioner filed I.A.No.143 of 2018 in O.P.No.108 of 2018 on the file of the Judge, Family Court-cum-III Additional District Judge, Warangal, seeking interim custody of his minor children for the period from 15.05.2018 to 15.06.2018. This petition was dismissed by the Court below by order dated 25.06.2018. Thereby, this revision is filed.

A bare perusal of the affidavit filed in support of I.A.No.143 of 2018 would show that interim custody of minor children was sought for the period from 15.05.2018 to 15.06.2018 and by the time I.A.No.143 of 2018 was decided, the relevant period was over. There was no other pleading as sought to be contended by the learned counsel for the petitioner. The only issue is whether interim custody sought by the petitioner could be granted during the relevant period mentioned above. As the period itself is over, the cause in the revision, therefore, does not survive for consideration.

The Civil Revision Petition is, accordingly, dismissed. It is needless to observe that it is open to the petitioner to file another application for future custody of his minor children. There shall be no order as to costs. Miscellaneous petitions, if any, pending shall stand dismissed.
