THE HON'BLE SRI JUSTI CE T.VI NOD KUMAR WRI T PETI TI ON No.26986 of 2019 ORDER:

This writ petition is filed questioning inaction on the part of respondent No.5 in filing charge sheet in Cr.No.143 of 2018, dated 29.12.2018 and to declare the said inaction as arbitrary, illegal and contrary to the provisos of Criminal Procedure Code. 2.

Heard the learned counsel for the petitioner and learned Assistant Government Pleader for Home.

Learned Assistant Government Pleader for Home, on written instructions, dated 05.12.2019, a copy of which along with FIR is placed on record, submits that based on the complaint of the petitioner a case in Cr.No.143 of 2018 has been registered and the police authorities took up investigation in the matter. It is further submitted that since the matter pertains to SC/ST Atrocities Act an elaborate inquiry has been conducted for which it took time and the investigation in the matter has been completed and the proposals are being sent to the higher authorities for approval and as soon as the approval is received, final report in the above crime will be filed.

Since it is stated that investigation in the matter has been completed and approval of the higher authorities is awaited, this Court is of the view that no further orders need be passed in the matter except observing that the authorities shall complete further necessary action as expeditiously as possible and file a final report in the above crime.

With the observations as above, the writ petition is closed. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
