ORDER
This writ petition is filed seeking to issue a Writ of Certiorari calling for the records relating to and connected with the order dated 1.10.2003 passed by the 2nd respondent and to quash or set aside the same by holding it as arbitrary and illegal.
Heard learned counsel appearing for the petitioners, learned Government Pleader for Industries and Commerce appearing for respondent No.1 and learned counsel appearing for respondents 2 and 3.
Learned counsel appearing for the petitioners submits that the petitioners were appointed as Sales Assistants in the year 1989 and they are working as such; that though they are eligible for regularization in terms of G.O.Ms.No.212, dated 22.4.1994, the respondents have erroneously rejected their cases vide impugned order; and that in pursuance of the interim direction granted by this Court on 19.12.2003, the petitioners are continuing in service.
Learned Government Pleader appearing for the 1st respondent submits that since the petitioners are not fulfilling the conditions laid down in the said G.O, they are not entitled
for regularization of their services and that the respondents have rightly rejected their cases.
Having considered the rival submissions made by the learned counsel on either side, this Writ Petition is disposed of directing the respondents to re-consider the cases of the petitioners for regularization of their services, in accordance with Rules, if they are continuing as on today, and pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order. No costs. Miscellaneous petitions, if any, pending shall stand closed.
