THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.8647 of 2005 ORDER:

The petitioner in this case, a Constable in the Central Reserve Police Force, is aggrieved by the proceedings dated 21.03.2005 whereby he was terminated from service. This termination is stated to have been effected on the ground of his suffering from Leprosy. Sri Abhinand Kumar Shavili, learned counsel for the petitioner, stated that as no interim order was granted by this Court in the present Writ Petition, Writ Appeal No.888 of 2005 was filed by the petitioner and by order dated 21.04.2005, a Division Bench of this Court granted interim suspension of the impugned proceedings dated 21.03.2005. The learned counsel further states that the petitioner was reinstated in service pursuant to the aforestated interim order and having been cured of leprosy, his services were also regularised.

Smt. K.Mani Deepika, learned counsel appearing for the Central Reserve Police Force, confirms this and further states that the petitioner has also been sent for training.

In the light of the afore-stated developments, it is clear that the impugned proceedings dated 21.03.2005 terminating the petitioner from service have lost their effect.

The Writ Petition is accordingly allowed setting aside the impugned proceedings.

Pending miscellaneous petitions shall stand closed in the light of the afore-stated final order. No order as to costs.
