HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.23230 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the action of the respondent authorities in refusing to provide new service connection to the petitioner residential house bearing No.1-3-2/2/3, Ward 175, Block-E, Bakaram, Musheerabad (presently known as Kavadiguda) Hyderabad as illegal, arbitrary and without jurisdiction and consequently direct the respondent authorities to provide new service connection to the petitioner's house by considering the representation dated 22.06.2016 and to pass such other necessary orders.
Heard the learned counsel for the petitioner and the learned Standing Counsel for respondents.
It is submitted that the petitioner has taken a DD for an amount of Rs.1855/- for the purpose of obtaining electricity service connection to the house bearing No.1-3-2/2/3. It is further submitted that the petitioner herein submitted a representation dated 22.06.2016 to the third respondent requesting him to provide new electricity service connection.
Learned standing counsel for the respondents submitted that the respondents cannot provide electricity service connection without complying with the necessary formalities as contemplated under law.
In view of the pendency of the representation of the petitioner, this Court is not inclined to express any opinion.
Having regard to the facts and circumstances of the case and also in view of the submissions made by both counsels, the third respondent is hereby directed to dispose of the representation of the petitioner dated 22.06.2016 in accordance with law within a period of one month from the date of receipt of this order. With the above direction, the writ petition is dispose of. No order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
