THE HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT APPEAL No.777 OF 2015 PC: (per the Hon'ble The Acting Chief Justice Dilip B. Bhosale) Mr. M.R.K. Chakravarthy, learned counsel for appellants prays for withdrawal of this appeal with liberty to appellants to challenge Government Orders, as observed in the concluding paragraph of the order of learned Single Judge, afresh and all contentions for challenging the orders may be kept open.

In the impugned judgment, learned Judge upheld the challenge to G.O.Ms.No.194, dated 26.03.2013 and G.O.Ms.No.123, dated 26.03.2013 and while setting aside those orders made it clear that it shall not preclude the respondents from taking into consideration the factors specified in the proviso to Article 243Q(1) of the Constitution of India and the proviso to Section 3(1) of the Andhra Pradesh Municipalities Act, and thereafter, passing orders afresh in accordance with law. In view of these observations, we allow learned counsel for the appellants to withdraw the appeal with liberty to challenge the orders, as and when passed by the respondents on all grounds that are available in law. All contentions are kept

open.

Writ Appeal is disposed of as withdrawn.

Consequently, miscellaneous petitions, if any, also stand disposed of.
