HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.23377 of 2003 ORDER:

This Writ Petition is filed seeking compassionate appointment under "Bread Winner Scheme." The counsel for the petitioner submits that respondents have rejected the case of the petitioner vide proceedings dated 15.07.2013 on the ground that the petitioner is falling short by one month. The counsel for the petitioner further contends that the petitioner's father was employed with the respondents and the petitioner's father has expired on 15.01.2001 while discharging his duties with the respondents. Therefore, the petitioner has submitted a representation to the respondents to consider his case for compassionate appointment. But the respondents without examining the case of the petitioner, mechanically rejected the case of the petitioner vide proceedings dated 15.07.2003 on the ground that the petitioner is falling short by one month to 18 years. The counsel for the petitioner contends that the case of the petitioner could have been considered after one month and he should be given appointment on compassionate grounds.

The Standing Counsel appearing for the respondent contends that the case of the petitioner will be considered for compassionate appointment in accordance with the policy of the respondent and appropriate orders would

-2be passed by examining the case of the petitioner. This court having considered the rival submissions of both the parties, is of the considered view that the Writ Petition can be disposed of directing the petitioner to submit a fresh representation seeking compassionate appointment in two weeks and the respondents shall consider and pass appropriate orders in accordance with the scheme for grant of compassionate appointment and pass appropriate orders in another four weeks. With these observations, Writ Petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. No order as to costs.
