The claim of the petitioner is that he is the owner and possessor of the subject land and that the respondents without following the due process of law and without initiating proceedings under the Land Acquisition Act for acquiring the same, are intending to encroach on to the subject property and construct a compound wall. Hence the writ petition. Heard the learned counsel for the petitioner and the learned Assistant Government Pleaders for School Education and Revenue. Having regard to the facts and circumstances of the case and without expressing any opinion on merits, the writ petition is disposed of at the stage of admission, directing the respondents not to take any steps without following the due procedure established under law, provided the subject land is private property of the petitioner.
