THE HON'BLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No.8266 OF 2017 ORDER:

Crime No.31 of 2014 was registered in III Town ACB Police Station, Visakhapatnam, on the allegation of demand and acceptance of bribe. On account of his involvement in the criminal case, by order dated 29.01.2015, the petitioner was placed under suspension and continues to be under suspension. The petitioner claims that there is no progress in the investigation by the police and so far charge sheet is not laid and by keeping him under suspension for more than two years, grave prejudice is caused to him.

No opinion can be expressed at this stage regarding continuation of suspension of the petitioner. Since petitioner has submitted representation on 02.09.2016 ventilating his grievance and praying to revoke the suspension, I deem it proper to dispose of the Writ Petition directing the Chief General Manager (ADM), T.S.GENCO, Vidyuth Soudha, Hyderabad, the 3rd respondent, to consider the said representation, examine the desirability of further continuation of suspension by ascertaining the status of investigation from ACB authorities and based on the information furnished by the ACB authorities, take appropriate further course of action. A decision to this effect shall be taken by the authorities concerned within a period of six weeks from the date of receipt of a copy of this order.

Subject to the above, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
