HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44077 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking a direction to respondents Nos.2 and 3 not to interfere with lawful possession of the petitioner over the subject property. 2.

Heard and perused the material available on record. 3.

It is stated in the affidavit that the unofficial respondents along with unsocial elements threatened the petitioner with dire consequences and trespassed into his vacant land. On 3.11.2016, a complaint was given to respondents Nos.2 and 3. But they did not register any case. The official respondents at the instance of the unofficial respondents are interfering with the civil litigation of the petitioner.

Learned Assistant Government Pleader submitted that the official respondents will not interfere in any of the civil disputes. 5.

Considering the facts and circumstances of the case and the grievance of the petitioner, this Court is inclined to pass the following order.

"Respondent Nos.2 and 3 are directed not to interfere with the affairs of the petitioner more particularly, with any of the civil disputes with regard to the subject property. At the same time, this order will not stand in the way of the above said respondents to proceed with the investigation, if any case is registered against the petitioner for cognizable offence."
